On 26 April 2024, an amendment to Decree No. 401/2010 Coll. (the “Decree“) came into force, which sets the basic rules for the operation of the transmission and distribution systems. The amendment to the Decree amends the contents of the Rules of Operation of the Transmission System, the Rules of Operation of the Distribution System, the Rules of the Transmission System Operator, the Rules of the Distribution System Operator, the Rules of the Underground Gas Storage Operator and the Commercial Terms and Conditions of the Market Operator, and at the same time adds a new Section 7a to the Decree, which sets out the contents of the Data Centre Rules.
The purpose of the aforementioned Amendment to the Decree is to incorporate the changes brought by LEX RES II, especially with regard to the planned launch of the operation of the Electricity Data Centre (EDC) at the beginning of July this year, as well as to ensure greater transparency of operators. For example, in the provisions of § 2(4) of the Decree, which deals with the Rules for the Operation of the Distribution System in the Electricity Sector, it is added that the Rules should also include the methods and conditions for the provision of power balance services provided by electricity producers to the transmission system operator through the distribution system.
The implementation of LEX RES II and in particular the launch of the EDS will also be guided by other implementing regulations currently being worked on by the MIT and the ERO, in particular the amendment of the Decree on the Electricity Market Rules or the planned launch of the Energy Communities Register.
